6.5. The estimated delivery time consists of the order processing time and the carrier's delivery time.

10. Checking Your Delivery
10.1. We recommend inspecting the packaging and contents of your order upon delivery.
10.2. In particular, please check for visible damage to the packaging, broken seals or signs of mishandling during transport.
10.3. If damage is visible, we recommend documenting it with photographs and requesting a damage report from the courier where possible.
10.4. Please contact us as soon as reasonably possible if your order arrives damaged or incomplete.
10.5. Failure to inspect the parcel immediately, refuse delivery or obtain a courier damage report does not remove or limit the consumer's statutory rights.
11. Right of Withdrawal and Returns
11.1. Consumers have the right to withdraw from a distance sales contract within 14 days without giving any reason, subject to the exceptions provided by applicable law.
11.2. The withdrawal period expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods. Special statutory rules may apply to orders involving multiple deliveries or separately delivered goods.
11.3. To exercise the right of withdrawal, the consumer must inform the Seller of their decision through an unequivocal statement, for example by post or email.

11.4. Consumers may use the model withdrawal form made available by the Online Store, but its use is not mandatory.
11.5. To meet the withdrawal deadline, it is sufficient to send the withdrawal notification before the 14-day withdrawal period expires.
Refunds
11.6. Following a valid withdrawal, we will reimburse all payments received from the consumer, including the original standard delivery cost, excluding any additional amount paid for a delivery method more expensive than the least expensive standard delivery method offered.
11.7. Reimbursement will be made without undue delay and no later than 14 days after receiving the withdrawal notification.
11.8. Refunds will be made using the same payment method as the original transaction unless another method has been expressly agreed, without imposing additional reimbursement fees on the consumer.
11.9. We may withhold reimbursement until the goods have been returned or the consumer has provided evidence of having sent them back, whichever occurs first.
Returning Goods
11.10. Products must be returned without undue delay and no later than 14 days after the consumer communicates their decision to withdraw.
11.11. The consumer is responsible for the direct cost of returning the goods, provided they have been informed of this obligation as required by law.
11.12. Returned products should include all accessories and components supplied with the original order.
Diminished Value of Returned Goods
11.13. Consumers are responsible for any diminished value of the goods resulting from handling or use beyond what is necessary to establish their nature, characteristics and functioning, provided they have been duly informed of their right of withdrawal.
11.14. We reserve the right to inspect returned products, including their condition, completeness, functionality and any signs of excessive use or damage.
11.15. If the returned product shows signs of use beyond what is necessary to inspect and test it, or if any components or accessories are missing or damaged, the consumer may be liable for the resulting reduction in value.
11.16. Any reduction in value will be assessed individually, based on the actual condition of the returned product and the extent to which its value has been diminished.
11.17. Where justified, the Seller may seek compensation for the diminished value, including by making a legally permissible deduction from the refund.
11.18. The presence of signs of use or damage does not automatically invalidate the consumer's statutory right of withdrawal.
12. Exceptions to the Right of Withdrawal
12.1. The statutory right of withdrawal does not apply to certain contracts specified by applicable consumer protection legislation, including Article 38 of the Polish Consumer Rights Act of 30 May 2014, where the relevant statutory conditions are met.
12.2. Examples of contracts that may be exempt include:
-
Goods manufactured to the consumer's specifications or clearly personalised.
-
Goods that are liable to deteriorate or expire rapidly.
-
Sealed goods which are unsuitable for return for health protection or hygiene reasons if unsealed after delivery.
-
Goods which, by their nature, become inseparably mixed with other items after delivery.
-
Certain services that have been fully performed with the consumer's prior express consent and the legally required acknowledgement of the loss of the withdrawal right.
-
Certain sealed audio or video recordings or computer software that have been unsealed after delivery.
-
Other contracts expressly excluded under applicable law.
12.3. An exception applies only where the relevant statutory requirements have been satisfied.
12.4. Merely ordering a product that is not normally held in stock does not automatically remove the consumer's right of withdrawal.
13. Manufacturer's Warranty
13.1. Certain products sold through the Online Store may be covered by a manufacturer's or other commercial warranty.
13.2. Warranty coverage, duration and conditions depend on the warranty provided with the relevant product.
13.3. Where a product develops a defect covered by an applicable warranty, the customer may submit a claim in accordance with its terms.
13.4. Any commercial warranty is separate from, and does not limit or replace, the consumer's statutory rights against the Seller.
14. Goods Not Conforming to the Contract
14.1. The Seller is responsible for supplying goods that conform to the sales contract in accordance with applicable consumer protection legislation.
14.2. If a product does not conform to the contract, the consumer may submit a complaint to the Seller.
14.3. Complaints can be submitted by email to piwnicarowerowa@gmail.com or in writing to the Seller's postal address.
14.4. To help us investigate the issue efficiently, we recommend including:
-
A description of the problem.
-
Photographs or a video showing the issue, where possible.
-
The order number, purchase date or other information identifying the purchase.
-
The remedy requested by the consumer.
14.5. A receipt is not mandatory where the purchase can be demonstrated by other suitable evidence.
14.6. We will respond to consumer complaints within 14 days of receiving them, in accordance with applicable law. Where the statutory consequence applies, failure to respond within this period means that the complaint is deemed accepted.
14.7. Where goods do not conform to the contract, the Seller bears the costs of repair or replacement as required by law, including necessary transport, labour and material costs.
14.8. We recommend contacting us before sending a bicycle or other large product for inspection so that suitable transport arrangements can be made.
15. Remedies for Non-Conforming Products
15.1. Where goods do not conform to the contract, the consumer may request repair or replacement in accordance with applicable legislation.
15.2. The Seller may provide the alternative remedy where the remedy requested by the consumer is impossible or would involve disproportionate costs, as permitted by law.
15.3. Repair or replacement will be carried out within a reasonable time and without significant inconvenience to the consumer.
15.4. Where the statutory conditions are met, the consumer may request an appropriate price reduction or withdraw from the contract.
15.5. These remedies may be available where, for example:
-
The Seller refuses or fails to repair or replace the goods in accordance with the law.
-
The goods remain non-conforming after an attempted repair or replacement.
-
The Seller indicates that the goods will not be brought into conformity within a reasonable time or without significant inconvenience.
-
The lack of conformity is sufficiently serious to justify an immediate price reduction or withdrawal.
15.6. The consumer cannot withdraw from the contract on the grounds of a lack of conformity that is insignificant, where this statutory restriction applies.
15.7. The Seller's statutory obligations are independent of any manufacturer's warranty.
16. Used Products
16.1. The Online Store also sells used bicycles, bicycle components and accessories.
16.2. Used products are identified as such, and their condition, specifications and any commercial warranty provided are stated in the relevant product description.
16.3. Used products may be sold under the VAT margin scheme where applicable.
16.4. Consumers purchasing used products online have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason, subject to the statutory exceptions.
16.5. Returned used products are subject to the same rules concerning diminished value as described in Section 11.
16.6. Consumers purchasing used goods retain their applicable statutory rights relating to goods that do not conform to the contract.
16.7. Any commercial warranty provided for a used product is separate from, and does not limit, the consumer's statutory rights.
16.8. The described condition of a used product, including any disclosed wear or imperfections, will be taken into account when assessing its conformity with the contract, in accordance with applicable law.
17. Product Information and Formation of the Sales Contract
17.1. Product descriptions, photographs and technical specifications are presented to help customers make informed purchasing decisions.
17.2. Technical product information may be based on specifications supplied by the manufacturer.
17.3. Customers place orders using the purchasing process available through the Online Store.
17.4. Before submitting an order, customers are provided with the relevant product details, prices, applicable delivery charges and available payment methods.
17.5. Where the order involves an obligation to pay, the checkout process must clearly communicate this obligation in accordance with applicable law.
17.6. The submission of an order, acknowledgement of receipt and conclusion of the sales contract are governed by the information communicated during the checkout and order acceptance process, subject to applicable law.
17.7. Information about the order will be provided to the customer electronically, including any confirmation required by law on a durable medium.
18. Order Refusal and Errors
18.1. The Online Store aims to provide accurate product availability information, pricing and specifications.
18.2. If an error occurs, we will contact the customer to explain the situation and propose an appropriate resolution.
18.3. Where legally justified, the Seller may refuse to accept an order before a contract has been concluded, including in circumstances involving suspected fraud or genuine product availability problems.
18.4. Where a sales contract has already been concluded, any subsequent cancellation or termination is subject to applicable law and the customer's statutory rights.
18.5. A pricing or technical error does not automatically entitle the Seller to cancel a legally binding contract.
19. Personal Data Protection
19.1. The controller of personal data provided by customers when using the Online Store is Janot Sp. z o.o.
19.2. Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Polish data protection legislation.

20. Alternative Dispute Resolution (ADR)
20.1. Consumers may use available out-of-court procedures for resolving complaints and disputes in accordance with applicable law.

20.7. Participation in an ADR procedure is subject to applicable legal requirements and the rules of the relevant dispute resolution body.
20.8. Nothing in these Terms and Conditions limits the consumer's right to pursue claims before the competent courts.
21. Amendments to the Terms and Conditions
21.1. The Seller may amend these Terms and Conditions where justified by changes to its business activities, services, technical operation of the Online Store or applicable legal requirements.
21.2. Updated Terms and Conditions will be made available on the Online Store website.
